These Terms and Conditions (“Terms”) govern your use of the AEserver Marketplace, the domain-name marketplace operated by AEserver FZE, a domain name and web hosting provider in the UAE (“AEserver”, “we”, “us”, “our”) and accessible at aeserver.com and my.aeserver.com. By listing a domain for sale, buying a listed domain, or otherwise using the AEserver Marketplace, you (“you”, “User”) agree to be bound by these Terms.
1. Definitions #

AEserver is a user of escrow.com under it’s general terms of services for the purpose of conducting secure payment transactions. This website is not part of the Escrow.com website or Internet Escrow Services, Inc. Furthermore, this website is not endorsed by Escrow.com in any way. |

2. Eligibility and account #
To use the AEserver Marketplace you must:
- Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher;
- Have full legal capacity to enter into binding agreements;
- Hold an active AEserver client account in good standing;
- Provide accurate, current, and complete information when registering, listing, or buying;
- Keep your AEserver account credentials secure and not share them with third parties.
To sell a domain you must additionally hold (or register and verify) an account at escrow.com, since all Seller payouts are settled through escrow.com.
3. The marketplace service #
The AEserver Marketplace is a venue that connects Sellers (who own domains and domain licenses registered with AEserver) and Buyers (who wish to purchase (transfer domain licenses) of those domains). AEserver acts as the operator of the venue, the payment processor for Buyers, the registrar handling the domain transfer, and the counterparty to the escrow.com transaction that settles the Seller payout.
3.1 What we are not #
AEserver does not appraise, warrant, or guarantee the value, quality, lawfulness, or non-infringing nature of any Listing. Sellers are solely responsible for the accuracy of their Listings, for owning and being entitled to sell each domain listed, and for the consequences of any Sale.
3.2 Listings are Buy-Now only #
All Listings are fixed-price Buy-Now offers. The AEserver Marketplace does not currently support auctions, counter-offers, or negotiation flows. The price set by the Seller at the time of Listing is the price the Buyer pays (plus any applicable taxes and fees).
3.3 Eligible domains #
Only domains registered with AEserver under the Seller’s own AEserver account may be listed. Third-party-registered domains, domains in transfer, domains with active disputes (UDRP, court order, registrar lock for cause), domains with fewer than 60 days remaining in their registration period, and domains otherwise restricted by the relevant registry may not be listed and will be removed if discovered.
4. Buyer terms #
4.1 Purchase and payment #
By clicking Buy now and paying the invoice generated by AEserver, you (the Buyer) make a binding offer to purchase the Listing at the displayed price. Payment is collected by AEserver via the payment methods available in your AEserver client area (credit/debit card, PayPal, bank wire, etc.). All prices on the Marketplace are exclusive of any applicable Buyer-side taxes unless stated otherwise.
4.2 Custody of funds #
Buyer funds collected by AEserver are paid to and held by AEserver’s escrow.com account in full until either (a) the domain is successfully transferred to the Buyer’s AEserver account and not validly disputed, or (b) the Sale is cancelled and the Buyer is refunded under section 4.4.
4.3 What the Buyer receives #
On successful completion of a Sale, AEserver transfers the domain (domain license) from the Seller’s AEserver account to the Buyer’s AEserver account by means of an internal registrant change. The domain remains hosted at AEserver throughout. The Buyer receives the same registrar-side bundle of services available to any AEserver-registered domain (DNS management, WHOIS privacy where the TLD allows it, renewal, transfer-out rights subject to registry rules, etc.).
4.4 Buyer protection and refund #
If the Seller does not click Accept on the Sale in their AEserver Marketplace dashboard within seven (7) days of payment, the Sale is automatically cancelled and the Buyer is refunded the full amount paid, using the original payment method, within seven (7) business days. For any other dispute, including but not limited to a domain not being transferred after the Seller has accepted, a defect in the domain, or a misleading Listing, the Buyer must contact AEserver support, who will mediate as the neutral party.
4.5 No buyer cancellation after Seller acceptance #
Once the Seller has accepted the Sale (section 5.3), the Buyer may no longer cancel unilaterally. If circumstances change before Seller acceptance, contact AEserver support and we will attempt to cancel the order; cancellation is at AEserver’s reasonable discretion. After the domain has been transferred to the Buyer’s account, the Sale is final, save for any rights granted under section 4.4 or applicable consumer-protection law.
5. Seller terms #
5.1 Seller representations #
By listing a domain, the Seller represents and warrants that they:
- Are the lawful and beneficial registrant (holder of the domain name license) of the domain at the time of Listing and at the time of Sale;
- Have full power and authority to sell and transfer the domain;
- Have not listed the domain in violation of any third-party right, including trademarks, names of public figures, or applicable laws;
- Are not subject to any sanctions, embargoes, or other legal restriction that would prevent the Sale.
5.2 Escrow.com payout email #
Before submitting any Listing, the Seller must declare and verify an escrow.com payout email. AEserver will email a confirmation link to that address; the link must be clicked within three (3) days. Listings are disabled until the email is verified. All Seller payouts are routed to the verified escrow.com account; AEserver does not pay Sellers by any other method.
5.3 Accepting the Sale (the 7-day window) #
When a Buyer pays for a Listing, a Sale row appears in the Seller’s Sold tab. The Seller must click Accept within seven (7) days. If the Seller does not accept within this window:
- The Sale is automatically cancelled;
- The Buyer is refunded in full (section 4.4);
- The Listing is removed from the public Marketplace;
- Repeated no-accepts may, at AEserver’s discretion, result in the suspension of Seller privileges under section 11.
5.4 Delivering the domain #
Upon clicking Accept, AEserver opens the escrow.com transaction for the Seller’s payout and funds it. The Seller must then provide, through the AEserver Marketplace dashboard:
- The EPP code (authorisation code) for the domain; and
- The Transfer Declaration: a PDF auto-generated by AEserver in the Sold tab, which the Seller must download, sign, and re-upload.
Once both items are received and verified, AEserver moves the domain from the Seller’s AEserver account to the Buyer’s AEserver account by means of an internal registrant change. The Seller authorises AEserver to perform this change on the basis of the signed Transfer Declaration.
5.5 Payout #
After the domain has been transferred, AEserver triggers the release of the seller payout through the funded escrow.com transaction. Receipt of funds, choice of withdrawal method (wire, PayPal, Wise, escrow.com balance, etc.), identity verification (KYC), and any restrictions applicable to the Seller’s country of residence are matters between the Seller and escrow.com directly and are governed by escrow.com’s own terms.
6. Fees and payouts #

7. Prohibited listings and conduct #
You may not list, buy, or use the AEserver Marketplace for any domain or activity that:
- Infringes a trademark, trade name, copyright, or other intellectual-property right of a third party;
- Constitutes typosquatting, name squatting in bad faith, or a violation of UDRP (Uniform Domain-Name Dispute-Resolution Policy) or the equivalent UAE policy for .ae, please refer to the aeDA/TDRA .ae domain name policy;
- Is intended for use in connection with phishing, malware distribution, fraud, money laundering, terrorism financing, illegal gambling, child sexual abuse material, or any other unlawful activity;
- Includes hate speech, incitement to violence, or material illegal in the United Arab Emirates;
- Is subject to sanctions imposed by the UAE, the United Nations, the United States, or the European Union, in respect of either party to the Sale or the underlying registrant;
- Misrepresents traffic, backlinks, age, or any other characteristic of the domain;
- Lists a domain that the Seller does not own or is not authorised to sell.
AEserver may, at its sole discretion and without prior notice, remove a Listing, cancel a Sale, refund a Buyer, withhold a Seller payout, suspend an account, and report the matter to the competent authorities if it believes any of the above has occurred or is reasonably suspected.
8. Domain-transfer mechanics #
Because both Buyer and Seller must hold AEserver accounts, every Sale results in an intra-registrar transfer (a registrant change inside AEserver’s own systems). There is no EPP-based inter-registrar transfer, no transition through the registry’s transfer queue, and no period during which the domain leaves AEserver’s care. As a consequence:
- DNS continuity is preserved during the transfer;
- The 60-day post-registration / post-transfer ICANN lock applicable to inter-registrar transfers does not apply, since no inter-registrar transfer takes place;
- Registry-level fees applicable to a transfer-out do not apply;
- The receiving Buyer immediately inherits full registrant control of the domain at AEserver.
9. Dispute resolution #
If a Buyer or Seller has a complaint about a specific Sale, they should first contact AEserver support. AEserver will act as the neutral mediator between Buyer and Seller and will, where appropriate, exercise its rights under sections 7 and 11 (Listing removal, Sale cancellation, refund, payout withhold, account suspension).
If informal resolution fails, the dispute will be submitted to confidential arbitration under the rules of the Dubai International Arbitration Centre (DIAC). The seat of arbitration shall be Dubai, the language shall be English, and the arbitration shall be conducted by a sole arbitrator. Either party may seek interim or injunctive relief from a competent court without prejudice to the arbitration.
10. Escrow.com (third-party service) #
Escrow.com is operated by Internet Escrow Services, Inc., an independent company licensed and regulated in the State of California, USA. Escrow.com is not affiliated with, controlled by, or under common control with AEserver. The relationship between AEserver and escrow.com is a commercial one whereby AEserver uses escrow.com as the settlement channel for Seller payouts.
By accepting a Sale and receiving a payout, the Seller acknowledges that:
- The Seller’s relationship with escrow.com is governed by escrow.com’s own General Escrow Instructions and other applicable agreements;
- Identity verification (KYC), withdrawal methods, currency conversion, and processing times are escrow.com’s responsibility, not AEserver’s;
- AEserver is not liable for escrow.com’s acts, omissions, downtime, or fees beyond the marketplace commission set out in section 6.
11. Account suspension and termination #
AEserver may, at its sole and reasonable discretion, suspend or terminate a User’s ability to list, sell, or buy on the AEserver Marketplace (in part or in whole) if the User:
- Breaches these Terms or the general AEserver Terms of Service;
- Repeatedly fails to accept paid Sales within the 7-day window (section 5.3);
- Lists prohibited content (section 7);
- Engages in fraudulent activity, chargeback abuse, or any conduct that exposes AEserver, other Users, or third parties to legal, financial, or reputational risk;
- Is required to be suspended by an order of a competent authority or by applicable law.
Termination does not affect the obligations of the parties in respect of Sales already in progress at the moment of termination, which will be completed or cancelled in accordance with sections 4 and 5.
12. Taxes #
Sale prices displayed on the AEserver Marketplace are exclusive of any applicable taxes unless explicitly stated otherwise. Buyers are responsible for any sales tax, VAT, withholding tax, or similar amount applicable in their jurisdiction. Sellers are responsible for declaring and paying any income tax, VAT, or similar amount on their payouts in their own jurisdiction. AEserver will charge UAE VAT at the prevailing statutory rate on the marketplace commission where required by UAE law.
13. Privacy #
AEserver processes personal data of Buyers and Sellers in accordance with its Privacy Policy. Sellers see only limited information about Sales (domain name, sale price, sale date, escrow.com transaction status between AEserver and themselves). Buyers’ payment data, billing addresses, and contact details are never disclosed to Sellers. WHOIS data of transferred domains is handled in accordance with the relevant registry’s policy and ICANN requirements (where applicable).
14. Disclaimer of warranties and limitation of liability #
The AEserver Marketplace is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, AEserver disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of Listings, and continuous availability of the Marketplace.
To the maximum extent permitted by law, AEserver’s aggregate liability to any User in connection with the AEserver Marketplace, whether in contract, tort (including negligence), or otherwise, is limited to the greater of (a) the total fees actually paid by that User to AEserver in connection with the Sale giving rise to the claim, and (b) two hundred United States dollars (US$200). AEserver is not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, loss of business, or loss of data.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable mandatory law (including, where applicable, consumer-protection law).
15. Changes to these Terms #
AEserver may amend these Terms from time to time. Material changes will be notified to Users by email (to the address associated with the AEserver account) and by a notice on the AEserver website at least fourteen (14) days before they take effect. Continued use of the AEserver Marketplace after the effective date constitutes acceptance of the amended Terms. If a User does not accept the amendment, they may terminate their use of the Marketplace before the effective date; in-flight Sales will be completed under the previous version of the Terms.
16. Governing law and jurisdiction #
These Terms are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Sharjah, without regard to conflict-of-laws principles. Subject to the arbitration clause in section 9, the parties submit to the exclusive jurisdiction of the courts of Sharjah for any matter that is not subject to arbitration or that requires interim relief.
